We were representing a high-level employee of a rather large corporation. He had a change-in-control agreement that had been triggered by (a) the acquisition of his company by a hedge fund and (b) a change in his job duties. He wanted out and he wanted what was coming to him. We negotiated long and hard with the employer’s general counsel and outside counsel. We finally got it done after explaining, “We all know how this is going to end. And we can either end it the easy way or the hard way. It’s your choice.” They ended it the easy way.
That was on Tuesday. On Thursday, we got a voice mail message saying, “I am now the former general counsel. I need your help.” Once an adversary; now a client. We took him on, went to bat and got a great outcome for him too.
